Terms of Service

These terms govern your use of the iChatUp service on ichatup.my (the “Service”). Please read them before creating an account. By creating an account or using the Service you agree to them.

1. Who you are contracting with

The Service in Malaysia is provided, sold and supported by Mozac Agency (company registration no. 202401002458), a company incorporated in Malaysia (“we”, “us”). We are the seller of record for every subscription bought on ichatup.my and the party that invoices you.

The iChatUp software, brand and platform are owned by iChatUp and licensed to us for Malaysia. iChatUp operates the platform infrastructure; it is not a party to this contract and does not bill you.

2. What the Service is

iChatUp puts an AI assistant on a WhatsApp number you control. It answers customer messages from the business information you provide, takes bookings, captures leads, shares your payment details and helps you take over conversations yourself. It works with a regular WhatsApp number via a linked-device connection (“Quick Connect”) or with the official WhatsApp Cloud API via Meta’s Embedded Signup. We are not affiliated with Meta Platforms, Inc.

The AI generates replies from your own business information. You are responsible for the accuracy of that information and for reviewing how the assistant represents your business. Payments from your customers go to your own bank account, DuitNow or payment link — we never hold or process your customers’ money.

3. Free trial, prices and payment

  • Every plan starts with a free 7-day trial of the full product. No card is taken and nothing is charged automatically when the trial ends; the assistant pauses until you choose a plan.
  • Prices are shown on ichatup.my/pricing in Malaysian Ringgit (MYR) and are the total you pay per month for the plan; where any Malaysian tax applies it is stated on the invoice. Prices may change; changes never apply to a period already paid for.
  • Subscriptions are billed monthly in advance through a Malaysian payment gateway (card or online banking). You will receive an invoice by e-mail for every payment.
  • Meta’s per-message fees for template messages sent over the official Cloud API (Marketer plan) are charged by Meta directly to your own Meta account, not by us.

4. Cancellation and refunds

You can cancel at any time from your dashboard; access continues until the end of the paid period and no further charges are made. First-time subscriptions carry a 7-day money-back guarantee. The full rules are in our Refund & Cancellation Policy, which forms part of these terms.

5. Your account

You must provide accurate details — including a working mobile number so we can reach you about your account — and keep your password safe. You are responsible for activity under your account and for your team members you invite.

6. Acceptable use

You agree not to use the Service to send spam, unsolicited bulk messages or anything that breaches WhatsApp’s Business Messaging Policy; to harass or harm anyone; to transmit malware; or to attempt to access other workspaces or the platform infrastructure. Bulk outreach is only available over the official Cloud API with Meta-approved templates, which is the compliant way to broadcast. We may suspend or close accounts that break these rules, without refund for the affected period.

7. WhatsApp and third-party services

The Service depends on WhatsApp and Meta, on AI model providers (currently OpenAI and Google) and on cloud infrastructure. We cannot guarantee their availability or that WhatsApp will not restrict a number. On a linked-device connection the assistant only replies to people who message first and paces itself to look human, but the decision to restrict a number is Meta’s alone and we are not liable for it.

8. Your data

How we and iChatUp handle personal data — including that data is processed on servers outside Malaysia — is explained in the Privacy Notice, which complies with the Personal Data Protection Act 2010. You can export or delete your workspace data at any time.

9. Liability

The Service is provided “as is”. To the extent permitted by Malaysian law, we are not liable for indirect or consequential loss, lost profits or lost data, and our total liability to you in any 12-month period is limited to the fees you paid us in that period. Nothing in these terms limits liability that cannot be limited under the Consumer Protection Act 1999.

10. Changes and termination

We may update these terms; we will give at least 30 days’ notice of material changes by e-mail or in your dashboard. Either of us may end the contract at any time — you by cancelling, we by giving notice or, for a breach of section 6, immediately.

11. Governing law

These terms are governed by the laws of Malaysia and the courts of Malaysia have jurisdiction. Consumers keep any rights they have under the Consumer Protection Act 1999 and the Consumer Protection (Electronic Trade Transactions) Regulations 2012.
